TERMS AND CONDITIONS OF USE OF THE UPPVENTURE.COM SERVICE

  1. GENERAL INFORMATION

1.1. These Terms and Conditions define the rules for using the online service https://uppventure.com, operated by Miłosz Anders, conducting business under the name “uppventure Miłosz Anders,” with its registered office at ul. Słodowiec 9/113, 01-708 Warsaw, NIP: 5922173409, email: hello@uppventure.com.

1.2. Definitions:

  • Client – a natural person, legal entity, or organizational unit without legal personality, who uses the service or places orders.
  • Product – digital content, such as online courses or e-books, available in the Shop.
  • Shop – the online service available at https://uppventure.eu.
  • Sales Agreement – the agreement concluded between the Owner and the Client in connection with the purchase of Products.
  • Owner – Miłosz Anders, conducting business under the name “uppventure Miłosz Anders.”
  • Order – the offer to purchase a Product placed by the Client through the Shop.

1.3. Materials and content provided in the Shop are protected by copyright and may not be used without the Owner’s consent.

  1. USING THE SHOP

2.1. To place an order, the Client selects a Product in the Shop and adds it to the cart. Then, the Client finalizes the order by providing the necessary details.

2.2. Registration in the Shop is not required, but it allows access to the order history and the ability to reuse purchased digital content.

2.3. The Client is required to provide accurate and complete information when placing an order.

  1. CONCLUSION OF THE AGREEMENT AND ORDER FULFILLMENT

3.1. Placing an order by the Client constitutes an offer to conclude a sales agreement.

3.2. The sales agreement is concluded at the moment the Owner sends the Client confirmation of order fulfillment.

3.3. The order fulfillment begins after payment is recorded.

3.4. Access to purchased digital content lasts for 12 months from the date of purchase.

  1. PRICES AND PAYMENTS

4.1. The prices of Products are listed in euros and include VAT. The applicable price is the one indicated for the Product at the time of placing the order.

4.2. Available payment methods are:

  • Online payments via PayU S.A.,
  • Bank transfer.

4.3. After payment, the Client receives a VAT invoice by email.

4.4. Taxes: Due to the international nature of sales, tax obligations may differ depending on the Client’s country of residence. For sales to non-EU countries, the prices indicated in the Shop are gross (including VAT). For Clients from EU countries, the Owner may apply VAT rates according to the Client’s country of residence. The Client may be required to pay additional customs duties or taxes associated with the import of goods, depending on the regulations in their country.

  1. RIGHT TO WITHDRAW FROM THE AGREEMENT

5.1. Products offered in the Shop, such as e-books or online courses, are digital content not stored on a physical medium.

5.2. According to Article 38 of the Consumer Rights Act of May 30, 2014, the Client loses the right to withdraw from the agreement if they consent to the immediate commencement of the performance.

5.3. If the Client does not consent to the immediate commencement of the performance, they can withdraw from the purchase before finalizing it.

  1. COMPLAINTS AND WARRANTY

6.1. The Owner undertakes to deliver Products free from defects.

6.2. In case of a Product defect, the Client may file a complaint by emailing hello@uppventure.com, specifying the nature of the defect and their request.

6.3. The Owner will consider the complaint within 14 days from its receipt and inform the Client of the outcome.

6.4. If the complaint is accepted, the Owner will repair or replace the Product, and if this is not possible, will refund the money or reduce the price.

  1. TECHNICAL REQUIREMENTS

7.1. To use the Products and the functionalities of the Shop, the Client needs:

  • A device with an internet browser that supports JavaScript and cookies,
  • An active internet connection,
  • An application for reading PDF files,
  • Capability to play videos.

7.2. Minimum hardware requirements:

  • Processor: 1.6 GHz or faster,
  • RAM: 1 GB,
  • Operating systems: Windows 10/11, macOS 10.13+, Ubuntu 16.04, Fedora 34.
  1. PERSONAL DATA AND COOKIES

8.1. The Client’s personal data is processed in accordance with applicable law for the purpose of order fulfillment.

8.2. Detailed information about personal data protection and cookies can be found in the Privacy Policy available on the Shop’s website.

8.3. The Client can unsubscribe from receiving the newsletter at any time.

  1. FINAL PROVISIONS

9.1. These Terms and Conditions are effective from December 1, 2024.

9.2. Any disputes between the Owner and the Client will be resolved in accordance with Polish law, except where the law in the Client’s country provides broader consumer rights.

9.3. The Consumer has the right to use out-of-court dispute resolution, including the European ODR platform available at ec.europa.eu/consumers/odr.

9.4. Changes to the Terms and Conditions will be published on the Shop’s website. Orders placed before the changes come into effect will be fulfilled under the previous terms.


Additional notes regarding international sales:

  • VAT Rates: If the Client is from a European Union country and provides a valid VAT number, they may not have to pay VAT on their purchase. For sales to non-EU countries, VAT does not apply, but additional customs fees may apply.

Additional Costs: For delivery to countries outside Poland, the Client may be required to pay additional charges (e.g., customs duties, import taxes). The Owner is not responsible for these additional costs.
